Kindly see a copy of letter from NHFDC Dated 31-01-2014 (copy placed at item 7 of Attachment RPN) addressed to Managing Director, West Bengal Women Development Undertaking, Salt Lake, Kolkata-700091. Perhaps you might be interested to know the factual background of the issue for better appreciation. Please go through correspondences made in connection with subject issue i.e. “Exemption, relaxations for old aged disabled persons-reg. …” moved sine 2009 onwards but subsequently converted into a loan case by NHFDC by its contradictory statement vide letter 25-04-2013  to an old aged disabled person [Placed at attachment RPN (1) to (7)]. It is very much surprising as well as painful to find that a member of Senior Indian Administrative Services officer in-charge of the unit has approved issue of letter dated 31-01-2014 which is purely a mispresentation / deliberate diversion of actual position according to all related official documents attached hereto.
 
 
Remarks on para 1 of NHFDC’s letter dated 31-01-2014 (at RPN 7)
 
I have made several correspondences since 2009 onwards with Ministry SJE, PMO, Secretary UN Org (Disabled) / Nu York etc in connection with “Exemption, relaxations for old aged disabled persons-reg…” but never applied for loan from SJE or NHFDC. Only on receipt of NHFDC’s letter dated 25-04-2013 I made a loan appeal as a test case as per revised condition provided therein. Hence the statement made vide para 1 is not correct as per records. My mail dated 06-05-2013 (at RPN 2) may be referred to.
 
Para 2 of NHFDC’s dated 25-04-2013 (at RAN 1) read as follows “…There is no upper age limit for availing financial assistance from NHFDC. Any person with 40% or more disability, age above18 years may apply for loan under NHFDC…” further NHFDC clarified vide it’s letter dated 10-09-2013 in reply to my mail dated 19-08-2013 that “….Th ere is no upper age limit for availing financial assistance from NHFDC. Any person with 40% or more disability, age above18 years may apply for loan under NHFDC schemes for self-employment…. “
 
 
Remarks on para 2 of NHFDC’s letter dated 31-01-2014 (at RPN 7)
I have no confusion as apprehended by you i.e. NHFDC. I have gone through the eligibility criteria for getting a loan published by you at your web site. NHFDC’s letter dated 25-04-2013 & 10-09-2013 are itself contradictory to provisions made & published at www.nhfdc.nic.in . My letter dated 12-09-2013 self explanatory (at RPN 4) in response to your letter dated 10-09-2013 is yet to be clarified / attended to but an attempt being made to deshoulder responsibility on some other agency.
As explained earlier that in connection with quarry made regarding issue of “Exemption, relaxations for old aged disabled persons-reg…” & I never prayed for any loan (except as per your sue -motto letter dated 25-04-2013 on 06-05-2013 (at RPN 1 & 2), I had never made any reference or contacted NHFDC hence it is not clear as to why NHFDC came up with a proposal for loan to this over aged extreme disabled person? I used to write all letters on my mail letter heads with full particulars i.e age, disability, photo, present job, connections organizations connected with social welfare works etc and as such None can claim that he is / was not aware of my age , disability etc. Under the circumstance you are requested to response to my letter dated 12-09-2013 & let me know the reason why I was contacted for a loan not intended for up to 25-04-2013 i.e. proposed by NHFDC. Any official deputed by MD / WBWDU / Kolkata attending me at my residence Kolkata or Bongaon in terms of your letter dated 31-01-2014 will be welcomed with a cup of tea but no counseling / advocating for a disabled organization to help aged disabled person [PWD, OAD] is considered necessary

Instant case is a sample that nothing has been done so far for betterment towards Old Aged Disabled Persons and intention for sympatric betterment to PWDs expressed by highest government authority are being ruled out / do not adhered to by implementing authority on some plea or other.
Ms. Stuti Kacker, Secretary (DD) of Ministry SJE (secretaryda-msje@nic.in ) for kind information in reference to her mail dated 28-10-2013 (at RPN 5). Some additional documents not available with her office may kindly be had from this mail for further action as deemed fit by SDD. Many thanks for your this communication. Actually to tell you the truth I did not apply or had any intention to obtain a loan but only wanted to know whether there exists any rule for exemptions, relaxations or any other special provisions are made for aged disabled persons since 2008 onwards. None of the concerned Government Department could tell me real position but each time advised the golden path to obtain a loan.
 
However since I am an aged retired central government pensioner, paralyzed disabled cannot move outside without escorts and find extreme difficulties for transport, I like to avail proposed loan to purchase a second hand car at the cost of rupees three lakhs. I will return the loan in 36 installments @ Rs.5000/-.Existing loan schemes will not suit this aged disabled. As the undersigned extreme disabled will not be able to attend any office for whatsoever reasons but papers submissions can be made through e-mails. In the event of my death prior to repayment of loan in 35 installments my wife i.e. joint pension holder will undertake the responsibility to repay the loan. Further details as needed will be provided to your office for further necessary action. A copy of this letter is endst to Dr.T.D.Dharial ccpd@nic.in  for kind information as he advised me to get a loan from Commissioner PWD / Kolkata. & PMO’s office in ref to my e-mail dated 06-05-2013 “permission to meet PM”

           NHFDC provides financial assistance in terms of loan to Persons with Disabilities for setting up income generating activities. There is no upper age limit for availing financial assistance from NHFDC. Any person with 40% or more disability, age above18 years may apply for loan under NHFDC schemes for self-employment.

There is no provision to provide financial assistance for purchase of a second hand vehicle. NHFDC provides loan for purchase of vehicle for commercial hiring or for enhancement of employment/self-employment prospects only. In reference to your letter quoted above he following are stated.

Para 1. Yet no confirmation that there exists any rule for exemption, relaxations or any other special provisions made for old aged disabled persons from any corner of the government dealing with cases related to PWDs & OADs. i.e. till now there exist NO rules made for Old Aged Disabled Persons. Request for a loan towards purchase of a second hand car on income generating activity basis in pursuance with your suggestions read with guide lines circulated under web link: www.nhfdc.nic.in. recorded vide e-mail dated 25.04.2013 to undersigned. You have stated vide mail dated 25.04.213 & 10.08.2013 that “There is no upper age limit for availing financial assistance from NHFDC” appears to be clearly contradictory to the provision made at instructions & circulated under web link mentioned at above? However it is presumed that upper age limit has been waived with the approval of a Competent Authority. I am a Paralyzed Disabled (60%) as per certificate PWD issued by Govt. of West Bengal.

Para 2. No comments since matter of records.

Para 3. Expression made under this para is logical as I have already indicated that there exist No rules made for Old Aged Disabled Persons which no government department can deny as such question of “No provision made …..” as indicated by you can not arise at all. Alternatively had it been a fact your office could have approached the “Competent Authority” duly obtaining finance concurrence and Legal vetting as may be required to approve deviation issue as per prevailing central government offices business system on the merit of a case. Incidentally it is to point out that in a similar way you have relaxed upper age limit to obtain a loan. Rupees three lacks loan requested to purchase a commercial 2nd hand car so that apart from PWD’s personal use to attend Govt. Rly. Hospital / Kolkata nearly 80 km from my residence & commercial use to cover up maintenance etc.

It is hoped that above clarification will be able to satisfy you for taking further necessary action at the earliest possible. Thanking you, Namaste,

Thank you very much from this extreme disabled for prompt action taken by you.

As desired, I am furnishing herewith the detail particulars of happenings with regard to “Exemption, relaxations for old aged disabled persons” and my submission vide my mail dated 08.05.2013 considering the nature of disposing an issue by S J E office.

I wanted to know if there exist any rules, exemptions, relaxations or any other provisions made for old aged disabled persons from S J E Ministry and others since 2009 onwards. Kindly see some specific correspondences made in this connection with Government authorities and U N Org. Disabilities / New York placed at Annexure “A”.  For your kind convenience only ‘Yellow’ hatched portion of the letters may kindly be seen. Unfortunately the letter of Sri. T.D.Dharial directing me to approach loan (not asked for) could not be made available to you since I might have deleted the same from my old aged computer.  However it is a fact that there exist NO safety, security, exemptions, relaxations or any other facility / provision / rules made for Old Aged Disabled Persons.

Kindly see my mail dated 06.05.2013 to Sri.V.Narayanswami, MoS to PM’s Office placed at Annexure “B”. Though being an extreme disabled person (as explained at above) I wanted to meet PM at his office to explain my grievances against 6 items including “Exemption, relaxations for old aged disabled persons”. On 25.04.2013 I received a mail from Sri. Rakesh Agarwal nhfdc97.amproj1@gmail.com  and in response I have submitted my proposal vide mail dated 06.05.2013 (all the copies of letters are placed at Annexure “B” for ready reference)

As regards item No.3 & 4 of my mail to Sri.Narayanswami, PMO (at Annexure “B” lying with S J E office and Commissioner for PWD / Kolkata for years together, now probably shifted to your office, I will be sending you cream papers for ready reference and further necessary action from your end.

Hope you will realize the situation after going through the contents of mail dated 12-09-2013 at attachment, and being the administrative head of the insinuation entirely entrusted with the job to develop / help to persons with disability may not like that his organization prefer an attempt bluffing to an old aged extreme paralyzed disabled person cannot move out side with out escorts. It is also expected that you may not like to consume unnecessary time in communicating decision of NHFDC for a case of old aged extreme PWD. A copy of this letter is being forwarded to all concerned deals with matters related to Old Aged Persons with Disability for whom nothing has been done so far.

Sir,

         NHFDC has received an E-mail dated 15.12.2013 from Shri Chinmaya Kar (Address – Paschimara, Bongaon, North 24 Parganas, West Bengal – 743 235) requesting to furnish information regarding NHFDC schemes especially age relaxation for availing financial assistance from NHFDC. Copy of the e-mail enclosed.

         It appears that Shri Kar has some confusion regarding the fact that there is no upper age limit for availing financial assistance from NHFDC. You are requested to depute a person from your corporation for getting on the spot information and giving him clear-cut understanding of the schemes and procedures for availing financial assistance under various NHFDC schemes. It may kindly be explained and confirmed to Shri Kar that at present, there is no upper age limit for availing financial assistance from NHFDC.

        You are requested to send a visit report to NHFDC at the earliest.

        This issues with the approval of CMD,NHFDC.
