Kindly refer to letter dated 17-09-2013, 26-12-2013, and 20-01-2014 in connection with subject issue brought to your kind notice for a clear views of Reserve Bank of India with regard to para 2 (b) observation of Chief General Manager / CSD / SBI / Mumbai’ s letter no. PB / PL / 177B / 118 dated 29.08.2013. In view of clear cut refusal by nodal authority of SBI to consider a case of Old Aged extreme Disabled person in absence of mandatory instruction from RBI you are requested to kindly see once again CGM / SBI’s letter dated 29.08.2013 at attachment & do needful action at your earliest. [Copy of all letters referred in this letter are placed at attachments for perusal]   
 
Letter issued by Department of communication / RBI dated 27-01-2014 do not indicate that the same is issued with your approval as the request was made to you, name and designation of the issuing authority. It is however not understood although several reminders issued from time to time since 17-09-2013, request of an over aged (ornament ally crowned as Sr.Citizen of the country), cerebral paralyzed disabled as detailed at above is completely neglected by an authority like Reserve Bank of India.     COMPLAINT
    PENSION LOAN: LOWERING OF INTEREST RATE

    We are in receipt of your e-mail dated 22.05.2013, requesting for reduction of interest rate on your Pension Loan account at our Tollygunge New Theatre’s Studio Branch (05680), West Bengal.

    2.     We have examined the same and have to advise as under:

    (a)    The rate of interest in an account is linked to the Bank’s Base Rate and is increased / decreased whenever there is a revision in Base Rate.
    (b)    The Reserve Bank of India (RBI) has not mandated any concessional rate on loans to pensioners / physically handicapped persons. Further, RBI guidelines on the subject, stipulate, inter-alia that the interest rate charged by the Bank should incorporate risk premium and in considering the question of risk, the presence or absence of security and the value there of should be taken into account. As you are aware, Pension Loans are clean advances with NIL security.
    (c)    Reducing the rate of interest based on the request of a borrower on a standalone basis is not feasible as it is discriminatory and may result in a spate of similar requests / complaints from all over the country.

    3.     We, therefore, regret our inability to accede to your request for lowering of interest rate on your Pension loan.
    4.     The Bank will be glad to offer all its Banking services to you in future as well in accordance with the extant criteria and norms.

    Thank you very much for your letter quoted above. It is presumed that the letter has got the approval of the authority to whom letter dated 22.05.2013 was addressed as instant issue is a policy decision of the bank related to concession / relaxation / exemption s etc to be provided to Persons with Disability & Old Aged Persons with Disability in terms of Government of India’s declarations made by POI & PM / India from time to time. I have no problem / complain in connection with Pension loan sanctioned to me except that some quarry was made with regard to minor departure of system prevailing but no answer received from dgm.customer@sbi.co.in , latest reminder in this respect issued on 7th Aug’2013. I strongly object inclusion of subject as “COMPLAINT” at your letter quoted above. Probably you are not aware that SBI’s comments recorded on “Rastrapati Bhaban Secretariat Portal” as follows” “PRSEC/E/2012/06124  Name:Shri chinmay kar Date of Receipt:26 Apr 2012 Current Status:Case disposed of Date of Action:15 May 2012Details: The complainant obtained the pension loan as per the then prevalent norms of the loan.  As per the agreement and arrangement leeter, duly executed by Sri Kar, the interest is being chaged as per the laid down stipulations of those documents.  Bank has no scheme for disabled Sr. Citizens' Pension Loan.  The said complaint is more in the nature of a representation rathen than a complaint for moderate interest between 8 to 9% after reducing it from the agreed rate”   

    Your expression against para’B’ is contradictory to CGMCSD / RBI’S letter dated 1st Feb’2013 to the undersigned. Question of ‘risk element etc’ does not arise for a pension loan as the entire pension element remains under custody of executive banker and in the event pensioner expired a declaration deed obtained from pensioner’s wife to the effect that “in the event of pensioner’s death EMI may be deducted from her F/ Pension”. Hence it is presumed that with an intention to increase volume of letter the same has been included. However a consolidated reply to your letter dated 29.09.2013 will be sent as soon as comments / opinion are received from entire expert well wishers to Person with Disability and concerned Government authority. In any case the letter dated 22.05.2013 will stand good. It is noted that you have very intelligently deshouldered responsibility with regard to Physically Handicapped persons to Reserve Bank authority and did not offer any remarks on “Differential Treatment made to Old Aged Disabled Person” pointed out to you vide letter dated 18.08.2013 & 06.09.2013 which clearly violets provision made under Declaration on the Rights of Disabled Persons Proclaimed by General Assembly resolution 3447 (XXX) of 9 December 1975, signed by India as a member nation, especially matters pertaining to Differential Treatment to a PERSON WITH DISABILITY.

    Assurances recorded under para 4 of your letter is general in nature and since SBI have BOLDLY declared that they do not have any scheme for Sr.Citizen Persons with Disability (as RBI did not issued any instruction in this regard) it is not understood how this assurances will help an extreme disabled poor person like undersigned. However I will be glad if the “Dear Friends PWD” at annexure is widely circulated at all SBI offices

    However we may expect that the issue may be settled with in a month so that a befitting article / report be sent to world forum for PWDs during ensuing “INTERNATIONAL DAY FOR DISABILITY – 3rd December’ 2013”. for useful wide discussions.
