Kind attention of all Ld.Executive Members of CRPD-OHCHR is once again invited to the submission made herewith. Please deny if you so desire.

As advised by enable@un.org vide their mail dated 12.7.2016 copy placed below a formal complain cum claim has been lodged with crpd@ohchr.org on 08.8.2016 and a special request by aged extreme Disabled can't move outside without escorts to arrange early hearing of the case considering age & disability factor etc.

Gentleman, you all will be extremely surprised to find that Ld. Wise Executive Members of CRPD - OHCHR did not take any action but preferred maintaining strict silence over the issue for a period August'2016 to March2017 although several reminders in almost every month has been issued. Most probably these Ld. Wise Executive Members were enjoying their in activeness to an aged extreme Disabled Persons acute troubles / difficulties had to face for their reluctant & nonsense attitude. Had really,sincerely these so called wise Members wanted to help aged Disabled they could have advised that they do not deal such cases it may be addressed to tb-petitions@ochcr.org as now have been advised by enable@un.org

Unfortunately most of the Persons with Disability do not any idea of the working practice of CRPD - OHCHR and puts them self in troubles / wasting unnecessary time etc. I, all our well wishers unable to appreciate work culture of CRPD - OHCHR which is exclusively shameful.

Kind attention is invited to large number of letters, correspondences made between Indian Railways & National Human rights Commission of India in respect of silence, ignore, neglect of appeal made for allowing Chinmay Kar to travel along with his attendant/ escort in same compartment of train he travels on the strength of Rly pass issued in his favor as Chinmay Kar, Disabled as narrated in detail at the top of letter head, cannot move without escorts. 168 reminder cum self detailed representation submitted to Indian Railways but they remained silent during the period 2009 and upto 2014 > 15 yrs > 168 reminders. Copies of letters given to NHRC and crpd@ohchr.org , UN-enable for information & necessary actions. For better appreciation please go through all copies of documents sent to you as attachment & copy of all important letters endst to you as an exhibit of the instant case.

A consolidated claim was made out against claims against Railways was made out on 22.12.2012 and placed on Railways since 136 and onward reminders with copy to all concerned connected. The claim made duly reasoned may kindly be seen in details to appreciate main causes behind claim and claim amount demanded.

On receipt of formal claim registered with NHRC of India, NHRC once again referred the matter to Indian Railways to send their comments on the complain & claim. Incidentally it is to mention that NHRC had several times wanted to know Rly’s comments on appeals made by Chinmay Kar but railways did not reply. It is understood on receipt of formal lodging of complain & claim Rly contacted NHRC authority and had a meeting with them. A confidential meeting held, unknown dealings made, subsequently it is noticed that case movement fully stopped since 06.01.2014. No hearing at NHRC Court held since 06.01.2014 even though several reminders issued to NHRC authority.

Both Railway & NHRC of India know that the undersigned being an absolute disabled person can’t move outside freely, a very poor Govt. pensioner will not be able to move Court of Law for proper justice and as such let him die without justice. I donor think the highest international authority for Human Right will like this type of dealings with an aged Disabled person and do needful so that he at least get justice before leaving this earth.

It is however stated that such letter of dissatisfaction will not have effect on defaulting departments like Railways & NHRC of this country, as such it is proposed such dissatisfaction or like letters may be addressed to Prime Minister & President of India for necessary action.

The entire issue is submitted before you for consideration and sends your judgment, comments to the concerned authority so that this aged extreme Disabled do not suffer any more and get proper judgment & relief before departure from lovely good earth. Wish for good days for everybody.

Even you will be surprised to find that Retired Hon'ble Judge, Mr.K.G.Balakrishnan, Chairman Human rights Commission of India is unable to say as to why the case lodged with NHRC vide D.No.1413453 dated 06-01-2014 had a sudden death immediate after a meeting held between law officer of NHRC & representative of railway i.e edpg.rly . The deal & financial deal if any made is not disclosed but the case has a sudden death without any hearing conducted by commission. Now it is not understood as to why NHRC Chairman Mr. K.B/Balakrishnan Ex Justice remain silent and likely not going to take action to restart the issue for its fair justice.
We hope active initiative will be taken by Chairman NHRC for proper justice to an aged Disabled person

One of your subordinate appears to be very smart. Since the authority issued has not indicated his name or designation it is presumed that some PEON of the department issued letter & wanted to hide the issue.

Kind attention is invited to my case mentioned at above. You might have not forgotten. Please let me know the development immediately since considerable time since consumed most unnecessarily. All the paraphernalia / requirement for instating a case have been met and necessary complain @ claim lodged with your organization to enter into the case. Incidentally it is stated that the entire case of 168 reminders cum self explained complain case & claim letter (most of them) have been endst to you for perusal during 2009 to 2014 the date formal complain& claim lodged with you. Further you may find that the issue have been referred to Railway administration by you from time to time for their comments but Railway Officers have neglected all references made by you to them / did not respond or reply. Be whatever it may be aged Paralyzed Disabled can’t move out side w/o escorts should not suffer and debar from justice. You are requested once again to let me hear about the development of the acse as immediately as possible so that further action needed may be considered.
