Harassment, Ignorance/ neglect & misbehavior made to
an aged extreme Paralyzed Disabled can’t move outside - resulting compelled to
withdraw BSNL Broad Band connection on protest. CGM/CTD sanctioned a free Modem
Type-1 to the undersigned vide E.Mail Dated 05.08.2009 but CAO/TR/ALIPORE
challenged authority of CGM & ignored / disregard orders of CGM. ( See
CGM’s order at para “E” of Attachment) Above quoted incidents & others
initiated by CAO/TR/BSNL/ALIPORE in July’2014 was reported to CGM/CTD in
details with time to time reminders by this extreme aged Disabled can’t move
out side but CGM/CTD failed to rectify or take any action against alleged
official. Based on strong , sound records, documents & correspondences made
between the parties CGM/CTD had no other alternative but to accept the charges
made and issued W.O to disconnect BB connection from 30-06-2015 vide E.Mail
Dated 24.06.2015 {Copy of references mentioned at 1 & 2 under ref may be
seen at Attachment para (A ) & para (B). BB connection disconnected as per
CGM/CTD’s W.O wef 30-06-2015.
Telephone bill of July’2015
including BB charges up to 30-06-2015 for Rs 1,100/- [incidentally this is last
Broad Band connection Bill against Tel. No. 0332402 6000] has since been paid
vide confirmation received through SMS received from BSNL Co and SBI Bank
(Pleas see both the SMSs at para “D” of Attachment]
You are requested to refer
penultimate para of my E.Mail Dated 31/21-05/06-2015 and arrange to refund all
the security deposits pertaining to Broad Band connection mentioned at my
E.Mail Dated 28-01-2014 except item No 1, SD for telephone
set. [Please see “Total SD position” at para “C” of Attachment] immediately
within stipulated time. Incidentally it is mentioned that all the SDs position
has been checked by BSNL officials while correcting illegal wrong bills made by
BSNL to harass this extreme disabled

In view of the fact that that Harassment, Ignorance/neglect &
mis behavior to an old aged paralyzed disabled, who can’t move outside till
continued by CAO/Alipore & BSNL, I have decided to discontinue to have BSNL Broad Band Connection only (2402-6000) w.e.f 30-06-2015. Broad
Band Connection should be disconnected on & from 30-06-2015, as a mark of protest to AGED DISABLED PERSONS. It may please be
noted that in view of above stand any bill drawn beyond 30-06-2015 in respect of Broad Band
connection only of phone No.24026000 will not be entertained. Since the
undersigned is an extreme paralyzed disabled as narrated above cannot move out
side, this be treated as formal notice. Please refer to my mail dated 22-01-2014 (See Attachment) and return Security Deposit held for Broad Band
within scheduled time frame to close BB chapter.

refund allowed towards wrong excess realization for Modem Type-1 as pointed out
vide 6th Status Report sent to CDM/BSNL on 25.0409, copy to CGM. Detail
calculations mentioning periods, relevant rules mentioning Act etc, refund of
service tax element and penalty for late refund of excess realized amount to be
clearly indicated for verification, acceptance for clearance of the case.
Present status of the case- Outstanding.
Para (b).
Application was made to provide "Plan UL750 (Reduced to 500)" which BSNL accepted on 27-11-2008
and as such status of user stands on 01-12-2008 was "Plan UL750 (Reduced to
500)" and not Plan UL750 as indicated by you.
BSNL's interpretation is not acceptable. Probably this interpretation is made
to get an extra amount of Rs. 250 as security deposit erroneously billed for.
However since the bill has been paid in due time the issue sands closed duly
recorded.
Para ©. Matter of
records. Up to Feb'09 bill it was O.K, .A.O / III / Alp's letter dated 13-04-09 remains uncomplied. Post manufactured reasons for discontinuance
of 20% discount is treated as a deliberate withdrawal of a benefit allowed,
virtually an official impropriety as
well as differential treatment to a PWD. Withdrawal of 20% discount is however
objected hence case not closed.
Para (d). Security
Deposit of Rs.750/- demanded since paid, case dropped. Justifications for
payment of Rs.750/- as one month Plan charges do not stand as explained vide Para-(b) above and hence
treated as arbitratory and not acceptable.

Please refer E-mail dated.06.08.09 to CMD & CGM. Being extremely
dissatisfied with the attitude and performance of BSNL Data one E-mail services
it has been decided to 'Stop' using Data one E-mail services. All concerned are
being notified accordingly.

This dialogue will be on. Mean while kindly see the real picture from your BBST
records annexed.
Para should be (g). Too
late decision. Unhealthy atmosphere prevailing months together could have been
arrested at initial stage between March to May'08 by allowing this. However
many thanks to BSNL for a sympatric kind consideration shown to an Old Aged
Disabled Person. Tel.Bill for the period 01-06-39 to 30-0609 and 01-07-09 to 31-07-09 are 552/- respectively. By allowing free Modem from Aug'09
necessary reduction in this regard effected in bill for the period 01-08-09 to 31-08-09 will be watched and
noted
On a careful
examination of the letters received from T.S. / H.Q., DET / ALP and A.O /
Tr.III / Alp, were interesting to note that each letters are contradictory to
others. However since the BSNL have shown some sympathy to Old Aged Hemaparasis
Disabled Patient, an offer remains open which is as follows:- "In the
event 20% discount is restored to the all other issues lying pending unsettled
can be discussed with between the parties at appropriate authorized level, duly
drawing out a Jt.minutes & settled with in 10 minutes time. Liability of
settling a case, lying outstanding with accepted default by BSNL rest with them
only.
