Kindly refer to above proposal submitted nearly 2 years back followed by reminders from different persons of the society. Incidentally it is to mention that a serious issue has come up for which Old Aged Disabled Persons are facing insecurity & unsafe for the under mentioned reasons.
“Under compelled circumstance whenever an aged disabled person has to sell out or purchase a piece of land or property some local boy’s charges heavy amount of donation to be paid for their club, festival, mandir etc. These boy’s, persons do not consider the capacity of the PWD to bear such donation amount.
Solution suggested: - Any type of demand for donation from a Senior Citizen Extreme Disabled Person will be treated as punishable offence and will have to be taken up by Police in terms of legal provision”.
Hope Government of India considering the factual position that there exist no rules to safeguard the interest of Old Aged Disabled Person will gear up administrative process to implement of the proposal as immediately as possible. Thanking you,

The following are submitted for your kind perusal and necessary action for its implementation as early as possible in the interest of old aged disabled persons cannot move out side with out an escort. So far no Relaxations, Exemptions or any special provisions made or exist for old aged disabled persons cannot move out side. Hope you will please needful Namaskar… Chinmay kar 31-07-2011
Exemptions, Relaxations & some special provisions required for Old Aged Disabled persons to ease their lives (With out any type of Financial involvement) for remaining days
(1). Normally old aged disabled persons & those cannot move out side for any purpose had to lead balance life with out accompanied by his sons / daughters for some reasons or other. Naturally these persons had to arrange, clear up / disputes if any related to payment of Electric Bills, Telephone Bills, Income Tax, Bank affairs, Corporation Building Tax, Booking & related works for domestic L.P. Gas etc. It becomes extremely difficult for a disabled person who cannot move out side to attend each & every time to get their requirements. Now a day, it is seen that in each and every matters there exist some disputes which can be settled by personal attendance only. To avoid difficulties by Aged PWDs including those cannot move out side it is proposed to introduce a devise so that OADs can get some relief to carry on an in cumbrance free life.
Relaxation, Exemptios & Spl. provisions rules urged for in respect of constraints:-
“All offices situated in the state of West Bengal deals with issues mentioned at above (Yellow hatched portion) should open a special counter “Help counter for Sr.Citizen, Disabled who cannot move” to entertain requisitions, complains, requests made by the consumer Sr.Citizen, Disabled cannot move out side either through letters or by e-mails and issue receipts, confirm through e-mails. Compliance be made on requisitions immediately and others settled with in 30 days from date of receipt and a compliance Report should be reported to nominated officer of the Govt. nodal officer for the purpose having magisterial powers to take necessary actions against defaulters.”
(2). Old Aged Disabled persons those cannot move out side had to call mechanics for various repair, replacement jobs for, T.V, CPU, Water pipe connection etc. As the OAD persons are normally very week individuals neither can run after the mechanic nor can argue for rates elements strongly for obvious reasons had to depend fully on mechanic (most of them are unknown). In most of the cases it is seen that mechanic takes away the defective elements for carrying out necessary repair works at his work shop but while returning the same replaces the defective elements with a substandard one / unusable elements. Thus OADs are cheated in almost every area. Very recently one computer mechanic taken away my CPU for some repair works but returned me with duly replacing my hard disk with another hard disk of other brand, completely a dead one. The matter was widely brought to the notice of all concerned through different global web site for general awareness. However to tune down reoccurrence of such incidents it is proposed to introduce a positive action lines in terms of lawful provision:-
“Fraud / cheating case made to Old Aged Disabled persons who cannot move out side should be reported to Supdt. of Police of the concerned district by letters or e-mails. On receipt of complains from OAD the concerned S.P will conduct suitable enquiry and take necessary actions as per prevailing rules and report compliance with in 30 days to the nominated officer of the Govt. nodal officer for the purpose having magisterial powers to take necessary actions against defaulters.”

(3). Old aged disabled persons those cannot move out side with out an escort had to depend on available relatives in all respects even for very small necessities. As a result there of some relatives creates undue pressure / threats on the aged disabled person to agree signing of deeds / documents with regard to land, property and assets belonging to OAD in such a way which is accordance with the desire of OAD. Only just because OAD is a physically week person had to depend on them for every purpose & no legal protection is available had no other way but to digest unwanted out come. To tune down such tendency the following is suggested for inclusion at Govt. orders.-
“Whenever an Old Aged Disabled person is required to execute a deed or document in respect of Land, Property and Assets belonging to him the same can be can be acted upon only after certification by a 1st Class Magistrate to the effect that the deed has been signed by concerned OAD with full consent and not under threat or pressure by any one. Unless such a certificate is issued by 1st Class Magistrate no executed deed of an OAD person will be treated as valid for enactment.”
(4). Old Aged Disabled Persons who cannot move out side with out an escort are required to attend office (even such directives are issued by the lowest person of an office) to get their documents, receipts, submission of applications, consent letters etc. It is very much difficult for an OAD can’t move out side to attend an office normally situated at thickly populated CBD area but these can be done by authorization, by e-governance or by deputing special messenger to OAD comfortably. A suitable Exemption orders in this respect on the following lines may be issued for the convenience of Old Aged Disabled Persons who cannot move out side for any purpose.
“It is hereby notified that that Old Aged Disabled Persons who cannot move out side with out an escort are Exempted to attend all offices situated in the state of West Bengal for getting their works done. Their cases be settled either utilizing e-governance system or by deputing special messenger to OAD. Deviations if any should be brought to the notice to the nominated officer of the Govt. nodal officer for the purpose having magisterial powers to take necessary actions against defaulters.”
Introduction of above said suggestions will not involve any financial implications on the Government authority. OADs should invariably mention at their applications “CASE OF SR. CITIZEN DISABLED CANNOT MOVE OUT SIDE” to get the proposed facility provided by Government. Government Doctors certificate to the effect that “the disabled person cannot move with out an escort” is obtained from a Government Doctor and produced whenever it is called for by any competent authority.
So far there exist no Relaxations, Exemptions or any special provisions made for Old Aged Disabled Persons cannot move out side wit out an escort for any purpose and as such the suggestions made above will render some relief to OAD persons. Hope Government at appropriate level will not hesitate to implement the above suggestions for betterment to aged disabled persons so long neglected, ignored by all. Thank you.

Unless such a certificate is issued by 1st Class Magistrate no executed deed of an OAD person will be treated as valid for enactment.”
(4). Old Aged Disabled Persons who cannot move out side with out an escort are required to attend office (even such directives are issued by the lowest person of an office) to get their documents, receipts, submission of applications, consent letters etc. It is very much difficult for an OAD can’t move out side to attend an office normally situated at thickly populated CBD area but these can be done by authorization, by e-governance or by deputing special messenger to OAD comfortably. A suitable Exemption orders in this respect on the following lines may be issued for the convenience of Old Aged Disabled Persons who cannot move out side for any purpose.
“It is hereby notified that that Old Aged Disabled Persons who cannot move out side with out an escort are Exempted to attend all offices situated in the state of West Bengal for getting their works done. Their cases be settled either utilizing e-governance system or by deputing special messenger to OAD. Deviations if any should be brought to the notice to the nominated officer of the Govt. nodal officer for the purpose having magisterial powers to take necessary actions against defaulters.”
Introduction of above said suggestions will not involve any financial implications on the Government authority. OADs should invariably mention at their applications “CASE OF SR. CITIZEN DISABLED CANNOT MOVE OUT SIDE” to get the proposed facility provided by Government. Government Doctors certificate to the effect that “the disabled person cannot move with out an escort” is obtained from a Government Doctor and produced whenever it is called for by any competent authority.
So far there exist no Relaxations, Exemptions or any special provisions made for Old Aged Disabled Persons cannot move out side wit out an escort for any purpose and as such the suggestions made above will render some relief to OAD persons. Hope Government at appropriate level will not hesitate to implement the above suggestions for betterment to aged disabled persons so long neglected, ignored by all. Thank you.
