As a Hemaparasis Disabled (60%), Sr. Citizen, right side of body fully paralyzed, cannot move without an escort had requested Ministry of Social Justice and Empowerment, Government of India in Nov'2008 to let me know if there exist any exemptions, relaxations and special provisions made in law for persons with old age disability and disabled. Several reminders have been issued but no reply received from ministry.
SJE department however in March'09 advised me to apply loan with Disabled Commissioner / West Bengal (Kolkata) India. Since I had no intension to get a loan I did not contact DC as advised. It appeared that there exist no specific rules made for benefit of old aged disability and disabled persons. It is understood from other Person With Disabilities (PWD) of the local area that practically no facility is available for PWDs except some reservations of seats made for disabled persons for appointment & education.

As the concerned ministry could not furnish any provision of law with regard to relaxations, exemptions and any special provisions for old aged disability and disabled, sue-motto proposal submitted to include necessary provisions at the PWD Act going to be amended in consultation with different social organizations dealing with PWDs. Besides above, various proposal / suggestions have been submitted to concerned ministry for consideration and implementation as these are all beneficial to a vast number of PWDs of the country.
However a test case was initiated by me to observe the reality - which is placed below for perusal and find out possible way of solution for the benefit of PWDs in future.

After retirement from services as a Hemaparasis disabled, right side of body fully paralyzed cannot move outside had to remain alone in a room with out any works etc. This was very much painful and was practically impossible for me to pass time for the remaining days. I had started operating computer / internet with my unusual left hand to cross pond rest part of world in connection with social welfare works for the betterment of old age disability and disabled persons as per advise of local PWDs and other NGOs. Unfortunately the computer set purchased by me in the year 2002 becomes out dated troublesome for the purpose of efficient working. Being a poor paid pensioner it has become impossible for me to purchase a new computer for me which has virtually become a life line for a disabled like me. I continued my working by a hired set. Situation being thus and as advised by well wishers a test case was initiated:-
1) Social Justice & Empowerment ministry of Govt. of India who advised me to apply for a loan with Commissioner Disability of the State Govt. was requested to supply me a computer set considering the factual position that a computer set has become an essential life line of this disabled in lieu of artificial limbs etc being supplied to the disabled person. After a long pursue the ministry forwarded my case for consideration by local Commissioner Disability / Govt. of West Bengal (India). CD / GWB remained silent for several months but had finally deshoulderd their responsibility by reforwarding the case to local state government for their consideration. Again several months passed away- several chasing made through E-mails to the local state government offices - No result. Possibly there will be no result. Case has gone to hell. It is however understood that according to these social welfare offices they had no powers to sanction any money for such issues. Had this be the fact then why this drama made over the years?

2) A similar appeal was made to Hon' Governor of West Bengal, India to consider my case. Hon' Governor considered the case and advised a leading NGO of the country i.e. Helpage India to help and advised me to keep contact with Smt. Susmita Ghose, National Director, Helpage India. As I cannot attend any office due to physical constraints deputed my daughter to meet Smt.Ghosh several times to contact apart from e-mail reminders. Unfortunately Smt Ghosh could not be contacted at Kolkata (India). Finally National Director, Helpage India was requested to send a regret letter so that the case may be closed and Hon' Governor may be advised accordingly when Helpage India reacted that they are considering the issue shortly. Incumbent Hon' Governor / W.B left West Bengal on 14-12-2009 on completion of his tenure and new Governor Résumés. The NGO in question consumed several months for consideration and finally the case is on the way to hell.

Net Result of above cases = 0 [NIL]

Primarily our programs are aimed at large groups of disadvantaged elderly who are below the poverty line and are unable to afford even the bare minimum. This is due to the fact that through such large scale programs, not only does our help and assistance reach a larger section of the disadvantaged elderly but also because having restricted funds we find it difficult, inspite of our best efforts, to fulfill every ones individual wishes. .However, after reading your e-mail regarding the computer, our National Director, Mrs. Susmita Ghose made an exception and personally took over the matter to try and arrange for a computer for you. In this scenario, it is pertinent to remember that being a Non-Government / Non-profit organization, we are sustained completely by funds / donations received from kind and generous donors and are by no means a business organization .In your case also, we appealed to many of our donors for a donation, so that you could be provided with a computer. However given the recessionary times have not received any favourable reply till date.In this scenario, when we are trying our utmost to help you even though we do not intervene in individual cases, we find your above referred mail very offensive and disconcerting. We request you to kindly appreciate that we are trying the best that we can.However, as mentioned above and in all our previous mails, since we are completely dependent on donations we cannot assure you a response.
