On the eve of International Day for PWDs 3rd Ded’2013 it is requested that “No useless, unproductive statement / declaration / assurance be made for Persons with Disability as these does not help PWDs in any way




INTERNATIONAL DAY FOR DISABLED PERSON ‘2013 – WHAT SHOULD BE OUR AIM FOR BETTERMENT OF DISABLED PERSON.

We do take oath on PWD 3rd December’2013 Day that:-

1) No useless, unproductive statement / declaration / assurance will be made for Persons with Disability as these does not help PWDs in any way. For safety, security, exemptions, relaxations, or any other rules made so far for the benefit / betterment to Old Aged Disabled / Disability Persons which are specifically brought to the kin knowledge of the concerned Government Administration for necessary action. Nothing done so far for OADs. Do every thing sincerely if you really want to help PWD and OAD persons.
2) Do help / assist a Disabled Person on merit according to your capacity / affordability but sincerely. Lord God will bless you rather you may feel satisfaction for such good works.
3) Do not insult, ignore, and neglect a Disabled Person.
4) Don’t make fun of the people with disability, regardless of what the disability is. Disability may be physical one, mental one but this disability do not stop them being wonderful human on globe. Every one has feelings, every one can feel heart.
5) You might be at your middle age but please don’t take guaranteed that you are absolutely safe on this globe. What will happen to you in next moment cannot be predicted by any one.
6) Whenever an Old Aged Disabled Person is cheated / deprived / compelled to sign / act on threat should report the matter to the local police authority [in case of aged disabled person e-mail complain to be accepted] who will render necessary services to the victim Disabled as immediately as possible.
7) For Persons with Disability there exists certain relaxations / relief’s available at Indian Railways but not being followed or allowed to be followed due to non cooperation by a sector of Railway employees. Railway Authority needed to ensure implementation of it’s framed rules for PWDs.
Administrators of a Department, concerned Minister in charge and Head of an administration will personally monitor an ensure that the issues presented by a Disabled / Aged Disabled are not unnecessarily delayed and disposed positively as immediately as possible.
9) Let all of us hope for a better tomorrow for every one.

It is hoped that some fine morning some kind hearted administrative authority may think twice and deny arguments placed before you…….. keeping in view the theme of INTERNATIONAL DAY FOR DISABILITY – 2012 Excuse me for inviting your kind attention to the prayers made to Railway Minister during Miss Mamata Banerjee’s  period for consideration of allowing my escort to accompany me in coach I am traveling owing to my absolute disability and allied reasons. Prayer has been made purely on humanitarian, religious, absolute disability & pilgrimage reasons by a Retd. Sr.Citien, Extreme Disabled / Disability person at the fag end of his life for due consideration as a token of cognition of services rendered, appreciated by Railways through 17 awards. I am well aware that existing rules does not cater such provision but rules are made by human being only & not by Lord God or treated as provision of Bible, but necessity, justification demands change, amendment, consideration on humanitarian reasons. Hope Government of India acting through the Railway Ministry will not debar this aged couple (ornamentally termed as Senior Citizen of India) in performing their religious intentions already narrated before you & your predecessors. In this respect it will not be out of place to mention that expenditure likely to be incurred in allowing the prayed issue will be absolutely negligible from finance point of view and as such there should be no reason to hold on decision for indefinite time. Incidentally with an intention to visit Ma Tara Temple at Tara pith, Kamrup Kamakhya at Gauhati, Tirupati Devasthanam, Hardwar etc to offer Puja for betterment of all of us submitted pass application to GM / M.Rly / Kolkata during past three years.  Sorry till date since no directive issued from Rail Board’s office, escort could not be included in pass by concerned GM. All religious programmed made had to be cancelled on account of railways. Thus continuously debarred to perform religious obligations at the fag end of life which is virtually my constitutional right. Kind attention is also invited to Declaration on the Rights of Disabled Persons Proclaimed by General Assembly resolution 3447 (XXX) of 9 December 1975  / 2007 especially matters pertaining to Differential Treatment to a PERSON WITH DISABILITY , please see link:http://www.ohchr.org/EN/ProfessionalInterest/Pages/RightsOfDisabledPersons.aspx  . Hope you will be kind enough to study the entire situation & issue suitable instructions as prayed for to the concerned GM / M.Rly /Kolkata., copy to undersigned as immediately as possible and oblige. Incidentally it is mentioned that the delay resulted deterioration of my disability which may kindly be noted. Arunendra Kumar  for compensation payment in this regard vide letter dated 22.12.2012 may be seen and immediate necessary action is taken. It may kindly be noted that by allowing time the appeal made for escort will have a corresponding raise of amount claim as compensation.

                                A very simple prayer made above on necessity & Humanity ground by a Retd. Disabled, Sr.Citizen of India, Humanitarian prayers made through 136 letters / reminders may please be seen.  Every appeal cum reminders is self explanatory. Railway did not acknowledge receipt nor a response made so far. Railways cannot deny receipt of136 letters / reminders mail from me
                               Since the undersigned, a paralyzed Disabled (entire right side of the body paralyzed) can’t move without an escort certified by a CMS of Railway Hospital submitted an appeal to highest authority of railways to allow his attendant / escort to travel in the same coach with me on the pass granted to me as per prevailing rules. Normally an attendant / escort has to travel at general sleeper coach 5 / 6 coaches away from the coach traveled by the pass holder and as such does not helpful to a Disabled like the undersigned.
                                 Situation being as mentioned above do our respected Chairman Sahab can deny that:-
1)    By way of remaining silent for 2188+ days, even after issue of 136 letters/reminders tantamount to a Neglect / Ignore / insult made to a Senior Citizen, Paralyzed Disabled, can’t move without an escort, made by railway authority?
2)    By way of remaining silent over three years from the date of receipt of 1st appeal made on 07-06-2009 allowed this physically disabled person (68 yrs) deteriorating physical handicapped ness to further extent. Railways silence caused my deterioration condition of Disability further which could have been avoided provided Railways at the initial stage of my appeal communicated the Disability of Railways to help / accept the simple prayer of a Senior Citizen, Paralyzed Disabled, who can’t move without an escort. Hence Railway is totally responsible for the damage done to a Disabled
Railways could not consider a very simple prayer of a genuine very aged extreme Disabled Person though all papers / documents relating to eligibility to get an escort to travel with the Disabled in question but arranged charity distribution of very costly free pass to a large number of  different persons of the society having absolutely No connection with Railway or Railway works at all and thus made a Differential Treatment with a Sr.Citizen, Paralyzed Disabled Person. 3)    Railways silence to the appeals of an Aged, Paralyzed Disabled debarred him in observing / availing religious as well as pilgrimage tours to Thirupati, Kamrup, Tarapith Vaishna Devi etc. This is to be noted that a Paralyzed disabled, can’t move outside with out an escort & if escort cannot accompany the Disabled Person the deserved journey cannot be made by Disabled in question. By such action Railways are responsible for preventing me to avail the fundamental rights of performing religious customary as provided in constitution.
4)    Had Railways at the very initial stage of the appeal made three years back expressed their DISABILITY to help an extreme Paralyzed Disabled Person then the question of Differential Treatment, Ignore, Neglect, Insult, Payment of compensation to a PWD would have not arisen. I would have make some adjustment & proceeded for pilgrimage. Amount claimed towards compensation is Rupees seven lakhs and fifty thousand only.

Hope that Mittal Sahab, well conversant with my case will render proper justice to this Disabled at the fag end of life and oblige, Thanking you, Yours faithfully,

It is a fact that you have charged 14.75% unusual highest interest to be paid for a small personal loan of Rupees 1.5 lks only by an extreme disabled can't earn a single farthing where as allowing 8 to 9 % low interest for loan of 25 lks to customers for purchase of cars & house building. REDUCING HIGHEST RATE OF INTEREST CHARGED AGAINST PERSONAL LOAN OF RUPEES ONE LAKH FIFTY THOUSAND FROM STATE BANK OF INDIA FROM A SENIOR CITIZEN RETIRED GOVERNMENT SERVANT (68+YRS), ENTIRE RIGHT SIDE OF BODY PARALYZED, DISABLED (60%), CANNOT MOVE OUT SIDE WITH OUT ESCORTS FOR WHAT SO EVER REASONS, UNABLE TO EARN A SINGLE FURTHING DUE TO EXTREME DISABILITY

Under extreme compelled circumstance I had to apply for Sr.Citizen, pensioner’s loan for an amount of Rs.1.5 lks in connection with marriage of my daughter on 27.06.2010 from SBI / TNT Branch (05680), Kolkata-700040 to meet expanses for daughter’s marriage.. Initially in accordance with prevailing bank’s rules as a Sr. Citizen pensioner I was eligible to get Rs.1.10 lks only. I had requested Chairman / SBI to grant me a loan of Rs.1.5 lks taking into consideration that not only I am a Sr.Citizen but also a Paralyzed Disabled cannot move out side for whatsoever purpose [Persons With Disability cases are not considered at SBI Bank’s rule]. Chairman / SBI had kindly approved my request.
Accordingly a loan of Rs.1.5 lks was sanctioned and deduction of loan & interest element @ Rs. 5342/- per month [36 installments] started w.e.f 02-08-2010. Interest element fixed for this loan is was unusual highest rate of 14.75% on total amount sanctioned to me. 
 As a Sr. Citizen, Paralyzed Disabled (60%), entire right side of body fully paralyzed but can only operate computer with unusual left hand to communicate rest part of world in connection with social welfare works for aged disabled persons, cannot move out side with out escorts, have no other income sources except small pension amount having burden maintaining family including an unemployed son, compelled to stay at Kolkata on a rented house to avail medical facility, time to time essential check up of post stroke sickness elements. It becomes very much difficult for me in these hard days to bear a higher rated interest element of 14.75% which virtually & seriously tells upon me & my dependents. Market price had gone through the roof by this time and as a result there of considering the financial constraints Government had to increase M.P. Vatha from Rs. 15,000/- to Rs. 50,000/- Incidentally it is to mention that rate of interest charged towards loan H.B.Advace & Purchase of Car up to Rs. 20 / 25 lakhs are 8 to 10% only where as loan to an aged disabled can’t earn a farthing is 14.75% - unbelievable!!!!. It is further surprising to note that although The President & Prime Minister of India expressed their deep concern for PWDs and directed to extend possible help to PWDs – State Bank of India do not hesitate to declare BOLDLY that they do not have any scheme for Persons With Disability.
Under the circumstance I had request the Government on 15.03.2012 followed by series of reminders to kindly consider reducing interest element on loan from Rs. 14.75% to a bearable moderate interest between 8 to 9% so that this extreme old aged disabled can get some financial relief at the fag end on earth. Since Branch Manager / SBI / TNT Studio (05680), Kolkata-700040 had stated both orally & through written confirmation that he has no powers to decrease or increase an interest element of a loan, prayer has been made to the highest authority of SBI for necessary action. [Incidentally it is to mention that the entire staff of SBI / TNT Studio Branch are very cordial and helpful to this extreme disabled]
Although prayer was made on 15-03-2012 SBI authority remained silent till a letter “NON SYMPATHIC DEALINGS BY STATE BANK OF INDIA TO A SR.CITIZEN, PARALYZED DISABLED PENSIONER” dated 20-11-2012 was issued by me. Immediately AGM / Customer / SBI from SBI assured justice to cases of Persons with Disability (PWD) vide letter dated 04-12-2012. [Copy of both the letters placed at attachment “AGM / SBI assurance” for ready appreciation]. Unfortunately the assurance of SBI turns to be a fake one as nothing has been done towards        reducing Highest rate of Interest charged for a simple loan granted to an aged extreme disabled government poor pensioner, can’t move outside and earn a single farthing. Reduction of highest interest charged was made on 15.03.2012 when only 20th EMI was paid. Now out of 36 EMI @ Rs.5,342/- 34th EMI has since been paid but assurance as well as SBI remains completely silent. In this context it is mentioned that any type of TOKEN CONSIDERATION in lieu of what has been prayed based on various justifications, explanations, situations financial considerations furnished will NOT be treated as a help to this extreme Disabled Person. Incidentally one eminent social welfare worker of New Delhi i.e Shivani Gupta has observed as follows on fb as “It is really shameful that a nationalized bank has no consideration for disability and the elderly while giving a loan. Your comparison to the car loan brings out how opportunistic the banking system is” This type of negative dealings to aged extreme disabled persons are not  at all desirable and should invariably be avoided by State Bank of India, a Nationalized Scheduled Bank. Kindly refer to all the references mentioned above. Decision of the SBI authority is yet to be received. AGM/C/SBI‘s assurance to aged disabled persons on behalf of SBI appears to be a casual and  fake as the same is not in conformity with dealings made for the instant case.  Incidentally it is to mention that prayer for reduction of unusual highest rate of interest was made on 15-03-2012 i.e. out of 36 EMI when only 20thth instilment was made. Now 33rd instilment have been made but your office have stopped all is activity.

As a Senior Citizen, Paralyzed, Disabled can’t move out side freely without an escort had to take a pensioner’s loan for Rs. 1.5 lks under compulsion on account of daughter’s marriage on 27.06.2010. For this loan State Bank of India is charging interest @ Rs.14.75% which is tremendusly a high rate of interest for a poor paid government pensioner & an aged paralyzed disabled who do not have any alternative source of income. Interestingly the same SBI is charging 8 to 10% interest on car or house building loan for 20 – 30 lks. Here in this country you will find that Vidhava (Widow) Bhata and Protibandhi (Disable) Bhata is sanctioned upto Rs. 400/- only per month. A cow consumes dry grass (cow food) per month for Rs.1,200/-. Since recently market price has gone through the roof, for which Hon’ble M.Ps Bhata has to be increased from Rs. 15,000/- to 50,000/-, I have requested SBI since 15.03.2012 to reduce interest element fron 14.75% to 8 to 10% considering my financial hardship. Consideration yet to be made by SBI authority though assured to a PWD.
In view of the facts narrated above you are requested to pen down your valued views so that appropriate authority and civilized citizen of the globe can be made known. Thank you every body.

What surprises me further is that the fodder for a cow per month cost more than the government expects person BPL to consume. I an completely amazed by the system.

Sonal Kumar So long we know that Indian Railways have some administrators who do not use their brain now we find some administrators available at State Bank of India who do not utilize their brain to understand a problem but depends on traditional general negative stands. This is not appreciated.

Subham Sen State Bank of India do not have any scheme for PWD or OAD Persons as declared by them very boldly - Thus they deny the desire / directive regarding welfare of Persons with Disability of President and Prime Minister of India. Please confirm so that this be discussed widely.

Ashim Debnath I have seen the entire correspondences made between chinmay kar & SBI for reducing highest rate of interest of personal loan charged to a Sr.Citizen, Paralyzed Disabled. Attitude towards PWDs are seems to be not at all friendly except one or two senior administrators. Attitude need be changed for PWDs immediately.

Chinmay Kar   Out of 36 installments i.e. EMI, 34 have since been paid on 02-05-2013. Chairman-SBI was requested on 15-03-2012 (20th EMI) to reduce extremely high rate of interest charged to a poor government pensioner, paralyzed disabled cannot move outside for whatsoever purpose 14.75% to 8 to 9%. State Bank of India assured to consider the case of PWD but till date nothing done by State Bank of India though assured on 04-12-2012.

Under compelled circumstances this Sr.Citizen, Paralyzed Disabled, who can’t move outside without an escort had to obtain a loan of Rs. 1.5 lks in June’2010 with interest @ Rs. 14.75% and EMI @ Rs. 5342/- P.M.
 
Presently due to absolute price hike on essential commodities etc it has become impossible to maintain family of a poor paid disabled pensioner. This aged physically disabled pensioner had no other way to earn money to cover up the financial deficiency.
 
Considering the above acute situation this aged disabled made an appeal to concerned ministry of Govt. of India to consider reduction of higher rate interest element from 14.75% to 8 to 10%. Kindly see the application made in this respect at annexure - duly earmarked “B” for ready appreciation. The concerned ministry forwarded the case to SBI authority for consideration. 
 
Now please see the most painful and non sympatric disposal made by State Bank of India placed at annexure – earmarked ‘A’ It appears that instead of this disabler’s prayer to the high administrative officer of the Bank some lower subordinate of the Bank made a mechanical  refusal reply without exercising brain. Had the case brought to the notice of an Sr.Administrative officer  of the State Bank of India the method of reply / disposal would have been in much better way. Please note the observation of SBI “As this is a policy matter…” – It is not that policy matters cannot be changed because this is a Bible provision or made by Lord God. Policy matters can be amended / modified by head of administration according to merit of the issue. However it is mentioned that aged persons of the locality could not appreciate the dealings made by SBI to an aged, absolute disabled person. The issue is being brought to the kind notice of Chairman of State Bank of India.

Kindly refer to all earlier request made by this Aged Pensioner, Paralyzed Disabled, can't move outside without escorts to attend any office etc, placed below for ready reference. It is a fact that you have charged 14.75% unusual highest interest to be paid for a small personal loan of Rupees 1.5 lks only by an extreme disabled can't earn a single farthing where as allowing 8 to 9 % low interest for loan of 25 lks to customers for purchase of cars  & house building. Kindly refer to letter dated 22-05-2013 and send your reply at the earliest. Thanks.

Decision of the SBI authority is yet to be received despite AGM/C/SBI‘s assurance to aged disabled persons on 04.12.2012.

Chairman SBI sahib might be feeling it below dignity to response to an old aged paralyzed disabled customer and allowing time so that total 36 EMIs are paid by the disabled customer and case is automatically closed.

However in case SBI authority boldly declare that “DUE TO SBI’S EXTREME DISABILITY REASONS THEY ARE UNABLE TO HELP AN AGED EXTREME PARALYZED DISABLED WHO CANNOT MOVE OUTSIDE WITHOUT ESCORTS” the case as stands on date vide letter dated 06.05.2013 may be closed duly notifying all concerned widely for information. Conditions mentioned at letters dated 06-05-2013 and 14-05-2013 will stand.

Kindly refer to all the references mentioned above. Decision of the SBI authority is yet to be received. AGM/C/SBI‘s assurance to aged disabled persons on behalf of SBI appears to be a casual and  fake as the same is not in conformity with dealings made for this aged disabler’s case.  Incidentally it is to mention that prayer for reduction of unusual highest rate of interest was made on 15-03-2012 i.e. out of 36 EMI when only 20thth instilment was made. Now 33rd instilments have been made but your offices have stopped all its activity. It is painful to note that SBI have boldly stated that they do not have any scheme for aged disabled persons although it doesn’t appears to be in conformity with government decision announced by POI and PM of India from time to time. You are requested to consider my prayer for reduction of unusual high rate of interest from 14.75% to 8 to 9% (at some letters it was wrongly indicated as 10%) based on various clarifications, justifications, financial considerations as well as humanitarian grounds through various letters issued to your offices. However it may kindly be noted that any type of TOKEN CONSIDERATION will not be treated as a help to an aged Disabled Person, prayed for only reduction of interest element from 14.75% to 8 to 9% with due reasons.
 
Hope you have realized the feelings of an aged disabled person and take positive action immediately treating this as MOST URGENT. Thanking you,
