Your kind personal attention is invited to the initiative of NHFDC and correspondences exchanged between this aged extreme disabled person with your office. Specially your personal attention is invited to my mail letter dated 12th September'2013 copy placed at attachment for your ready reference and save unnecessary consumption of time by way of hunting papers.

Hope you will realize the situation after going through the contents of mail dated 12-09-2013 at attachment, and being the administrative head of the insinuation entirely entrusted with the job to develop / help to persons with disability may not like that his organization prefer an attempt bluffing to an old aged extreme paralyzed disabled person cannot move out side with out escorts. It is also expected that you may not like to consume unnecessary time in communicating decision of NHFDC for a case of old aged extreme PWD. A copy of this letter is being forwarded to all concerned deals with matters related to Old Aged Persons with Disability for whom nothing has been done so far.

In reference to your letter quoted above he following are stated.

Para 1. Yet no confirmation that there exists any rule for exemption, relaxations or any other special provisions made for old aged disabled persons from any corner of the government dealing with cases related to PWDs & OADs. i.e. till now there exist NO rules made for Old Aged Disabled Persons. Request for a loan towards purchase of a second hand car on income generating activity basis in pursuance with your suggestions read with guide lines circulated under web link: www.nhfdc.nic.in. recorded vide e-mail dated 25.04.2013 to undersigned. You have stated vide mail dated 25.04.213 & 10.08.2013 that “There is no upper age limit for availing financial assistance from NHFDC” appears to be clearly contradictory to the provision made at instructions & circulated under web link mentioned at above? However it is presumed that upper age limit has been waived with the approval of a Competent Authority. I am a Paralyzed Disabled (60%) as per certificate PWD issued by Govt. of West Bengal.

Para 2. No comments since matter of records.

Para 3. Expression made under this para is logical as I have already indicated that there exist No rules made for Old Aged Disabled Persons which no government department can deny as such question of “No provision made …..” as indicated by you can not arise at all. Alternatively had it been a fact your office could have approached the “Competent Authority” duly obtaining finance concurrence and Legal vetting as may be required to approve deviation issue as per prevailing central government offices business system on the merit of a case. Incidentally it is to point out that in a similar way you have relaxed upper age limit to obtain a loan. Rupees three lacks loan requested to purchase a commercial 2^nd hand car so that apart from PWD’s personal use to attend Govt. Rly. Hospital / Kolkata nearly 80 km from my residence & commercial use to cover up maintenance etc.

It is hoped that above clarification will be able to satisfy you for taking further necessary action at the earliest possible. Thanking you, Namaste,

Please refer to your e-mail dated 19.08.2013 requesting National Handicapped Finance and Development Corporation (NHFDC) to furnish information on any rule for exemption, relaxations or any other special provisions made for old aged disabled persons and also requesting for loan for purchase of a second hand car.

NHFDC provides financial assistance in terms of loan to Persons with Disabilities for setting up income generating activities. There is no upper age limit for availing financial assistance from NHFDC. Any person with 40% or more disability, age above18 years may apply for loan under NHFDC schemes for self-employment.

There is no provision to provide financial assistance for purchase of a second hand vehicle. NHFDC provides loan for purchase of vehicle for commercial hiring or for enhancement of employment/self-employment prospects only. For further details on NHFDC schemes you can also log on to our website www.nhfdc.nic.in.

This type of articles are posted at different social network and others so that individual PWDs / OADs, persons well wishers to PWDs / OADs & non government organizations sincerely likes to do betterment to these entire Disabled Persons for general awareness only so that they are able to realize how PWDs are treated even on date. It is hoped that some fine morning some kind hearted administrative authority may think twice and deny arguments placed before you…….. keeping in view the theme of INTERNATIONAL DAY FOR DISABILITY – 2012 Excuse me for inviting your kind attention to the prayers made to Railway Minister during Miss Mamata Banerjee’s period for consideration of allowing my escort to accompany me in coach I am traveling owing to my absolute disability and allied reasons. Prayer has been made purely on humanitarian, religious, absolute disability & pilgrimage reasons by a Retd. Sr.Citien, Extreme Disabled / Disability person at the fag end of his life for due consideration as a token of cognition of services rendered, appreciated by Railways through 17 awards. I am well aware that existing rules does not cater such provision but rules are made by human being only & not by Lord God or treated as provision of Bible, but necessity, justification demands change, amendment, consideration on humanitarian reasons. Hope Government of India acting through the Railway Ministry will not debar this aged couple (ornamentally termed as Senior Citizen of India) in performing their religious intentions already narrated before you & your predecessors. In this respect it will not be out of place to mention that expenditure likely to be incurred in allowing the prayed issue will be absolutely negligible from finance point of view and as such there should be no reason to hold on decision for indefinite time. Incidentally with an intention to visit Ma Tara Temple at Tara pith, Kamrup Kamakhya at Gauhati, Tirupati Devasthanam, Hardwar etc to offer Puja for betterment of all of us submitted pass application to GM / M.Rly / Kolkata during past three years. Sorry till date since no directive issued from Rail Board’s office, escort could not be included in pass by concerned GM. All religious programmed made had to be cancelled on account of railways. Thus continuously debarred to perform religious obligations at the fag end of life which is virtually my constitutional right. Kind attention is also invited to Declaration on the Rights of Disabled Persons Proclaimed by General Assembly resolution 3447 (XXX) of 9 December 1975 / 2007 especially matters pertaining to Differential Treatment to a PERSON WITH DISABILITY , please see link:http://www.ohchr.org/EN/ProfessionalInterest/Pages/RightsOfDisabledPersons.aspx . Hope you will be kind enough to study the entire situation & issue suitable instructions as prayed for to the concerned GM / M.Rly /Kolkata., copy to undersigned as immediately as possible and oblige. Incidentally it is mentioned that the delay resulted deterioration of my disability which may kindly be noted. Arunendra Kumar for compensation payment in this regard vide letter dated 22.12.2012 may be seen and immediate necessary action is taken. It may kindly be noted that by allowing time the appeal made for escort will have a corresponding raise of amount claimed as compensation for rupees one and half lakhs per year or a part thereof..

A very simple prayer made above on necessity & Humanity ground by a Retd. Disabled, Sr.Citizen of India, Humanitarian prayers made through 136 letters / reminders may please be seen. Every appeal cum reminders is self explanatory. Railway did not acknowledge receipt nor a response made so far. Railways cannot deny receipt of136 letters / reminders mail from me

Since the undersigned, a paralyzed Disabled (entire right side of the body paralyzed) can’t move without an escort certified by a CMS of Railway Hospital submitted an appeal to highest authority of railways to allow his attendant / escort to travel in the same coach with me on the pass granted to me as per prevailing rules. Normally an attendant / escort has to travel at general sleeper coach 5 / 6 coaches away from the coach traveled by the pass holder and as such does not helpful to a Disabled like the undersigned.

Situation being as mentioned above do our respected Chairman Sahab can deny that:-

1) By way of remaining silent for 2188+ days, even after issue of 136 letters/reminders tantamount to a Neglect / Ignore / insult made to a Senior Citizen, Paralyzed Disabled, can’t move without an escort, made by railway authority?

2) By way of remaining silent over three years from the date of receipt of 1^st appeal made on 07-06-2009 allowed this physically disabled person (68 yrs) deteriorating physical handicapped ness to further extent. Railways silence caused my deterioration condition of Disability further which could have been avoided provided Railways at the initial stage of my appeal communicated the Disability of Railways to help / accept the simple prayer of a Senior Citizen, Paralyzed Disabled, who can’t move without an escort. Hence Railway is totally responsible for the damage done to a Disabled

Railways could not consider a very simple prayer of a genuine very aged extreme Disabled Person though all papers / documents relating to eligibility to get an escort to travel with the Disabled in question but arranged charity distribution of very costly free pass to a large number of different persons of the society having absolutely No connection with Railway or Railway works at all and thus made a Differential Treatment with a Sr.Citizen, Paralyzed Disabled Person. 3) Railways silence to the appeals of an Aged, Paralyzed Disabled debarred him in observing / availing religious as well as pilgrimage tours to Thirupati, Kamrup, Tarapith Vaishna Devi etc. This is to be noted that a Paralyzed disabled, can’t move outside with out an escort & if escort cannot accompany the Disabled Person the deserved journey cannot be made by Disabled in question. By such action Railways are responsible for preventing me to avail the fundamental rights of performing religious customary as provided in constitution.

4) Had Railways at the very initial stage of the appeal made three years back expressed their DISABILITY to help an extreme Paralyzed Disabled Person then the question of Differential Treatment, Ignore, Neglect, Insult, Payment of compensation to a PWD would have not arisen. I would have make some adjustment & proceeded for pilgrimage. Amount claimed towards compensation is Rupees seven lakhs and fifty thousand only.

Hope that Mittal Sahab, well conversant with my case will render proper justice to this Disabled at the fag end of life and oblige, Thanking you, Yours faithfully,

Casual & routing disposal of an issue placed before Prime Minister's Office [PMO] - by simply forwarding the same to concerned department bears no value…. .

Thank you very much for considering the acute troubles for this extreme disabled coming down to Delhi to meet PM on any date in July’2013 as requested for and alternatively allowed your office to pursue matters mentioned, referred to concerning authorities.

Out of 6 Nos of issues mentioned at letter dated 06-05-2013 position of 2 cases are being brought to you knowledge for further necessary action. Since PMO is the highest administrative office of the country it can be expected that instead of ‘a routine course of forwarding a case to concerned department for N.A by a forwarding officer’ action as deemed fit be taken by your office at an appropriate level. Routine forwarding a case to Railways does not carry any value as railways do not honor any letter unless it is signed by an officer at least of equivalent rank.

As regards item ‘A’ you have forwarded my letter for necessary action by railways. Why no action taken by railways is already known to you. Do you support the action / dealings by railways neglecting / ignoring request followed by 160 reminders in a civilized country to a Sr.Citizen, Paralyzed Disabled can’t move without escorts? Positive initiative & befitting actions expected from highest administrative office of the country and not merely forwarding cases.

Similarly as regards ‘B’ you have vide memo. PMO ID No. 11 / 3 / 2013 – PMP2 59236 dated 26-06-2013 simply forwarded a copy of letter to Secretary, D/O Financial Services & M / O Finance. As usual no action taken by these two officials. These types of very casual dealings cannot be expected from the highest administrative office of the country. You need to do some thing positive so that this aged disabled can get some relief at the fag end of his life.

Although it will be very difficult for this extreme disabled to attend Delhi to meet P.M. it is earnestly requested that necessary permission may kindly be accorded at your earliest.
